Appeals
Representation on appeal before the Court of Appeals and the Supreme Court.
Who this is for
Clients who lost, or partly lost, a case in a lower court or tribunal and want to elevate it, and clients who won and need to defend the decision on appeal.
Common situations
- You lost a case and want to know if you can appeal
- You won, and the other side has appealed
- You received a decision and are unsure of the deadline
- You want a second opinion on a decision from a lower court or tribunal
How we can help
We handle cases on appeal (definition: A request for a higher court to review the decision of a lower court or tribunal. Appeals are subject to strict deadlines.). Usually, our clients are those who seek legal representation in the appellate courts or at the Supreme Court (definition: The highest court in the Philippines.) level. If you lost your case at the first level courts such as the Metropolitan Trial Courts (MeTC), Municipal Trial Courts in Cities (MTCC), Municipal Trial Court (MTC), or Municipal Circuit Trial Courts (MCTC) or in certain cases, the Regional Trial Court (definition: A trial court that hears many civil and criminal cases and, in some cases, reviews decisions of first-level courts. It is often called the RTC.) (RTC), you may choose to elevate your case to the Court of Appeals (definition: The Philippine court that generally reviews decisions of the Regional Trial Courts and certain tribunals.) (or the RTC in its appellate jurisdiction in such cases). This is where our work comes in.
We represent clients in the appellate stage, including cases elevated to the Court of Appeals or to the Supreme Court.
What happens next
- 1We review the decision and the date you received it
- 2We assess whether and where an appeal can be made
- 3We prepare and file the appeal and related papers
- 4We represent you in the appellate court and keep you informed
The exact steps and timing depend on your matter. We explain them at your consultation.
Received a decision? See how long it has been.
Appeals have strict deadlines. Enter the date you received the decision and we will show how many days have passed. This is not a legal deadline calculator, so please speak to a lawyer immediately either way.
What to prepare before your consultation
- A copy of the decision or order you want to appeal
- The date you received that decision (appeal deadlines are strict)
- The case number and the court that decided it
- Copies of the main pleadings and evidence, if you have them
- Any motion for reconsideration already filed
This is a general starting list. Requirements differ for each case, and we will confirm the exact documents you need during your consultation.
